These Terms & Conditions (T&C) are shown in German above. The English version is provided further below.
§1 Geltungsbereich
Für alle Lieferungen von Produkten des Shops WebDragon (Elyndor – Fantasy Art & Collectibles) (nachfolgend WebDragon genannt) an Verbraucher gelten diese AGB.
Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu einem Zweck abschließt, der überwiegend weder ihrer gewerblichen noch ihrer selbstständigen beruflichen Tätigkeit zugerechnet werden kann.
WebDragon führt alle Lieferungen ausschließlich auf Grundlage dieser AGB aus.

§2a Vertragsschluss
Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot dar, sondern eine Aufforderung zur Bestellung.
Bitte beachte, dass Farben der Produkte aufgrund von Fotografie, Bildbearbeitung und Monitoreinstellungen leicht abweichen können.
Durch Anklicken des Buttons [Kaufen / kostenpflichtig bestellen] gibst du eine verbindliche Bestellung der auf der Produktseite gelisteten Waren ab.
Der Kaufvertrag kommt zustande, wenn wir deine Bestellung durch eine Auftragsbestätigung per E-Mail unmittelbar nach Erhalt annehmen.
§3 Widerrufsrecht
Du hast das Recht, binnen 14 Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen.
Die Widerrufsfrist beträgt 14 Tage ab dem Tag, an dem du die Ware erhalten hast.

Folgen des Widerrufs:
Nach Erhalt der Ware erstatten wir den Kaufpreis. Die Kosten für die Rücksendung trägt der Käufer, außer der Fehler liegt bei uns.
Ausnahmen:
Produkte, die speziell nach deinen individuellen Vorgaben angefertigt werden (z. B. personalisierte Tassen), sind vom Widerrufsrecht ausgeschlossen, es sei denn, sie sind fehlerhaft oder beschädigt.
Defekte oder beschädigte Produkte:
Bitte kontaktiere uns innerhalb von 7 Tagen nach Erhalt. Wir prüfen den Fall und bieten Ersatzlieferung oder Rückerstattung an, falls der Fehler von uns verursacht wurde.
§4 Preise und Versandkosten
Alle Preise enthalten die gesetzliche Mehrwertsteuer.
Zusätzlich fallen Versandkosten an, die im Checkout angezeigt werden.
Die Lieferzeit beträgt ca. 5–7 Werktage für Handmade-Produkte.
§5 Zahlung
Die Zahlung erfolgt über die im Checkout angebotenen Zahlungsmethoden (z. B. Shopify Payments, PayPal).
§5b Zahlungsverzug
Bei Zahlungsverzug (14 Tage nach Rechnungsstellung) ist WebDragon berechtigt, gesetzliche Verzugszinsen und eine Pauschale nach §288 BGB zu erheben.
§6 Lieferung
§6 Lieferung
Alle Produkte werden handgefertigt. Die Produktionszeit beträgt ca. 5–7 Werktage.
Nach Fertigstellung erfolgt der Versand:
- EU (inklusive Irland): 3–7 Werktage
- Schweiz: 7–14 Werktage
- Vereinigtes Königreich (England, Schottland, Wales, Nordirland): 7–14 Werktage
- Japan / Korea: 10–20 Werktage
- USA / Kanada: 10–20 Werktage (sofern verfügbar)
Wir haften nicht für Verzögerungen durch Versanddienstleister oder Zoll.
§7 Eigentumsvorbehalt
Bis zur vollständigen Bezahlung bleibt die Ware Eigentum von WebDragon.
§8 Geistige Eigentumsrechte
Alle Inhalte (Produkte, Texte, Illustrationen, Grafiken, Bilder, Videos) stehen in unserem Eigentum oder werden lizenziert.
Du erwirbst keine Rechte an den geistigen Eigentumsrechten.
Produkte dürfen nicht ohne Genehmigung weiterverkauft oder kommerziell genutzt werden.
§9 Gewährleistung
Wir haften nach den gesetzlichen Gewährleistungsbestimmungen für Qualitäts- und Rechtsmängel der Produkte.
§10 Haftungsbeschränkung
Weitergehende Schadensersatzansprüche sind ausgeschlossen, außer bei Vorsatz oder grober Fahrlässigkeit.
Haftung bei leichter Fahrlässigkeit ist auf vorhersehbare Schäden begrenzt.
Bestimmungen gelten auch zugunsten unserer Mitarbeiter oder Erfüllungsgehilfen.
§11 Änderungen der AGB
Wir behalten uns vor, diese Bedingungen bei Bedarf anzupassen.
Neue Bedingungen gelten für Aufträge, die nach Inkrafttreten erteilt werden.
§12 Gerichtsstand / anwendbares Recht
Es gilt das Recht der Bundesrepublik Deutschland.
§13 Schlussbestimmungen
Sollte eine Bestimmung unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.
Unwirksame Bestimmungen werden nach Möglichkeit durch wirksame Ersatzbestimmungen ersetzt.

§1 Scope
These Terms and Conditions apply to all deliveries of products from the WebDragon shop (Elyndor – Fantasy art & Collectibles) to consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not related to their commercial or independent professional activity.
All deliveries are executed exclusively based on these Terms and Conditions.

§2a Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but merely an invitation to order.
Please note that product colors may vary slightly due to photography, editing, and your device settings.
By clicking the [Buy / Place Order] button, you submit a binding order of the listed products.
The purchase contract is concluded when we confirm your order by email immediately after receiving it.
§3 Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day you take possession of the goods.

Consequences of Withdrawal:
Upon receipt of the goods, we will refund the purchase price.
You bear the cost of return shipment unless the defect or issue lies with us.
Exceptions:
Products made to your individual specifications (e.g., personalized mugs) are excluded from the right of withdrawal, unless they are defective or damaged.
Defective or Damaged Products:
Please contact us within 7 days of receipt. We will review the case and provide a replacement or refund if the issue was caused by us.
§4 Prices and Shipping Costs
All prices include statutory VAT.
Shipping costs are additional and displayed clearly during checkout.
Production time for handmade products is approximately 5–7 business days.
§5 Payment
Payment is processed via the methods available at checkout (e.g., Shopify Payments, PayPal).
§5b Default of Payment
In case of payment default (14 days after invoice receipt), WebDragon is entitled to statutory interest and a flat fee according to §288 BGB.
§6 Delivery
All products are handmade. Production time is approximately 5–7 business days.
After production, shipping times are:
- EU (including Ireland): 3–7 business days
- Switzerland: 7–14 business days
- United Kingdom (England, Scotland, Wales, Northern Ireland): 7–14 business days
- Japan / Korea: 10–20 business days
- USA / Canada: 10–20 business days (if available)
We are not liable for delays caused by shipping providers or customs.
§7 Retention of Title
Products remain the property of WebDragon until full payment has been received.
§8 Intellectual Property Rights
All products, texts, illustrations, graphics, images, videos, and other content sold in the shop are owned by us or licensed to us.
You acquire no rights, claims, or participation in our intellectual property.
Products may not be resold, reproduced, or used commercially without permission.
§9 Warranty
We are liable according to statutory warranty provisions for defects in quality or title of the products.
§10 Limitation of Liability
Further claims for damages are excluded, except in cases of intent or gross negligence.
Liability for slight negligence is limited to typical, foreseeable damage.
The provisions also apply for the benefit of our employees and vicarious agents.
§11 Amendments to Terms
We reserve the right to update these Terms occasionally, e.g., for legal changes or new features.
New terms apply to orders placed after the effective date.
§12 Governing Law / Jurisdiction
The laws of the Federal Republic of Germany apply.
§13 Final Provisions
Should any provision of these Terms be invalid, the remaining provisions remain valid.
Invalid provisions shall be replaced by valid provisions that achieve the intended economic purpose as closely as possible.
